The terms governing your use of Funfinity Games and Battle Toys

Welcome to Funfinity Games ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of Battle Toys and any other games, applications, websites, or services we offer (collectively, the "Services"). By downloading, installing, or using any of our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.
You must be at least 13 years of age to use our Services. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf. We do not knowingly offer our Services to anyone under 13 without parental consent where required by law.
We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use our games for your personal, non-commercial entertainment purposes, subject to these Terms. You may not copy, modify, distribute, sell, lease, sublicense, or reverse-engineer any part of our Services unless expressly permitted by applicable law.

All purchases are processed by the platform provider (Apple App Store or Google Play Store) and are subject to their respective terms and refund policies. We do not directly handle payment information. All in-app purchases are final unless otherwise required by applicable law or the platform provider's refund policy.
Our games may include virtual currencies, items, or other digital goods ("Virtual Items"). Virtual Items have no real-world monetary value and cannot be exchanged for real currency. We reserve the right to manage, modify, or remove Virtual Items at any time. Your purchase of Virtual Items grants you a limited license to use them within the game only.
All content within our Services, including but not limited to game code, artwork, graphics, music, sound effects, text, character designs, logos, and trademarks, is owned by Funfinity Games or its licensors and is protected by intellectual property laws. You may not use, reproduce, or distribute any of our content without prior written permission, except as expressly permitted by these Terms.
If our Services allow you to submit, post, or share content (such as feedback, suggestions, or screenshots), you grant us a worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, and distribute that content in connection with our Services. You represent that you own or have the right to submit any content you share.
We may suspend or terminate your access to our Services at any time, with or without cause, and with or without notice. You may stop using our Services at any time by uninstalling the game. Upon termination, your license to use the Services is immediately revoked, and any Virtual Items or progress may be forfeited.
Our Services are provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that our Services will be uninterrupted, error-free, or free of harmful components. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law, Funfinity Games and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of our Services. Our total liability for any claim arising from these Terms or our Services shall not exceed the amount you paid us in the 12 months preceding the claim, or $50, whichever is greater.
You agree to indemnify, defend, and hold harmless Funfinity Games and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of our Services or your violation of these Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or our Services shall be resolved in the courts located in Florida.
We may update these Terms from time to time. When we do, we will revise the "Effective Date" at the top of this page and, where appropriate, notify you within the game. Your continued use of our Services after any changes constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.
